These Terms and Conditions may be amended by us at any time by updating them on our website. If you would like an updated version of the Terms and Conditions and you do not have access to our website, a current copy can be obtained in our Salon. You should review these Terms and Conditions prior to undertaking any treatment in our Salon, each time you access our website and before placing any order with us. By continuing to use our services you agree to be bound by the Terms and Conditions as amended from time to time. By purchasing any product or scheduling any treatment with EBC you are deemed to accept these Terms and Conditions.

Limitation of Liability for Evodia Beauty Care website use

To the fullest extent permitted by law, EBC does not accept any liability arising from the information on the Evodia Beauty Care website or any websites linked to our website being incorrect, incomplete or in any way misleading. To the maximum extent permitted by law EBC will not be liable for any loss, damage, cost or expense incurred in or arising by reason of any person relying on the information on our website.

Terms of Trade

These Terms and Conditions apply to your purchase of any product or treatment via our website or in person at our Salon at any time.

No Warranty

To the fullest extent permitted by law, EBC gives no warranty in respect of any products available for sale on our website or in our Salon. In particular, EBC does not accept any liability in relation to the products purchased by a customer being suitable to their skin type or needs unless a customer has personally attended at EBC and has undertaken a skin consultation with us in our Salon.

Where the products we have available for sale come with warranties and guaranties that cannot be excluded by law, and if EBC breaches any of these warranties or guarantees, then you are entitled at your option to a refund or replacement of the products pursuant to these Terms and Conditions.

1 GIFT CARDS

1.1 Where can I buy a Gift Card?

EBC Gift Cards can be purchased on the website or at our Salon.

An EBC Gift Card entitles the customer to purchase products or treatments at the nominated value on the EBC website or in our Salon.

The value of the gift card can be used for purchases in whole or in part, and on multiple occasions, towards the cost of products or treatments.

A Gift Card cannot be reloaded, exchanged, or redeemed for cash or another Gift Card.

1.2 How long are EBC Gift Cards valid for?

Gift cards are valid for 36 months from the date of purchase

Please note that certain Gift Cards, including but not limited to those that were sold on or before 1 November 2019, Gift Cards that part of a temporary marketing promotion, donated for promotional purposes or given as a bonus in connection with the purchase of a good or service may be valid for less than 36 months. Customers are personally responsible for taking note of and using these Gift Cards in accordance with their period of validity and any other associated terms and conditions.

1.3 Can I buy a Gift Card on the website but request a physical card to be sent by post?

You can select what form you want your Gift Card to be in. You can purchase a physical Gift Card online and at our Salon. Digital Gift Cards are only available through our online store.

If you are purchasing a Gift Card online, please carefully select the kind of Gift Card you would like to receive as our electronic Gift Cards are sent out automatically upon payment.

If you select an electronic Gift Card and then later decide you want a Gift Card posted to you (or the recipient) please let us know as soon as possible and during business hours on 0498 354 241 or info@evodiabeautycare.com.au and we will try out best to send one out for you. Please note, there are postage costs associated with EBC sending out a physical Gift Card which will be charged to you.

1.4 What if I lose my Gift Card?

Gift Cards are treated like cash and cannot be replaced if lost so make sure you keep it somewhere safe.

1.5 What if I don’t get my electronic Gift Card?

Please check your junk mail or spam email folder as sometimes our emails are filtered as junk mail.

If, after checking your junk or spam you still can’t find out e-Gift Card your voucher, please email info@evodiabeautycare.com.au with your purchase order number and we will track down your order for you.

1.6 Is there a separate section to enter in recipient details?

We have a section where you can fill in the recipient’s details and include a message. This section is optional and you can skip this section if you wish.

1.7 What can’t I purchase using a Gift Card?

Gift Cards cannot be used on treatment packages or on special offers for treatments or product sales, including but not limited to Black Friday, End of Financial Year sale or discontinued product lines.

1.8 Can I obtain a refund on my Gift Card?

EBC Gift Cards cannot be exchanged or refunded once purchased. Your Gift Card can only be redeemed in the form of products or treatment on the EBC website or at our Salon.

1.9 Can I transfer my gift card into someone else’s name?

Yes, but it must be authorised by EBC management. Please contact us on 0498 354 241 to transfer a Gift Card into someone else’s name.

1.10 What if I purchased a Gift Card of a specific value for a specific treatment but the price goes up when I try to book my treatment?

Our prices may be subject to change from time to time.

EBC Gift Cards are valid for 36 months and can be used to book a treatment up to the maximum value of the Gift Card during that time. If at the time of booking the price of the treatment has changed, you will need to pay any difference in value if the Gift Card is not sufficient to cover the full cost of your chosen service.

2 TREATMENT TERMS AND CONDITIONS

2.1 Can I schedule a treatment in person at the Salon?

Yes.

2.2 How can I purchase a treatment online?

When you book a treatment online, you can:

  1. Create an account with EBC on our website by registering your details and creating an online login and select your treatment and appropriate payment method; or
  2. Select your treatment and an appropriate payment method as a visitor to our website only.

You are required to pay for your treatment in full at the time you book an online appointment.

2.3 How far in advance of a treatment should I arrive?

Please arrive 15 minutes before your appointment if you have scheduled a skin treatment. For all other appointments, please arrive 5 minutes prior to your scheduled appointment.

If you are a new client, please arrive 15 minutes before your appointment regardless of the type of appointment.

If you are running late for your appointment, please contact EBC on 0498 354 241 as soon as possible. If you arrive late this may impact on the duration of your treatment.

If the arrival time requirements for your appointment changes, EBC will notify you as soon as practicable.

2.4 What should I wear to my treatment?

EBC offers many different treatments. We will let you know if there is something specific you should or shouldn’t wear when you schedule your treatment. If you have any specific questions though, please just ask and we will be happy to give you as much information as possible!

2.5 Can I claim a health insurance rebate from EBC services?

No.

2.6 What is the EBC cancellation policy?

We request a minimum of 48 hours notice should you wish to reschedule or cancel your appointment. Failure to do so may result in a 50% cancellation fee.

If you need to reschedule your appointment within the 48 hours prior to your scheduled appointment, please call 0498 354 241.

Please note, EBC will not take note of or respond to any text messages or emails regarding cancellations, whether sent during EBC business hours or outside EBC business hours. We have a strict policy of managing all issues relating to cancellations or rescheduling appointments via telephone on 0498 354 241.

If you do not attend your appointment without the required prior notice EBC is entitled to retain 100% of the cost paid of your scheduled treatment.

2.7 Can I get a treatment if I am pregnant?

If you are pregnant, please let us know at the time you make your booking. Some treatments are not suitable for women who are pregnant and/or lactating. We will work with you to ensure your treatment is right for you.

You have the onus of full disclosure regarding your current state of health and pregnancy when making a booking. EBC will rely on your disclosure when recommending or advising you about appropriate treatment and products.

EBC will not be liable for any recommendations or advice provided on the basis of any information provided by you that is not accurate or which is incomplete.

2.8 Can I get a treatment if I am under 18?

Customers who are not yet 18 are welcome to enjoy some of the treatment offered by EBC under the supervision of a parent or guardian.

If you are under 18 or making a booking for someone under 18 please contact EBC on 0498 354 241 so we can discuss which treatments are suitable.

2.9 What else do you need to know about me before a treatment?

If you are feeling unwell leading up to or on the day of your appointment, we kindly ask that you let us know and reschedule your treatment to protect our staff and other clients

If you have any injuries or skin conditions, please let us know at the beginning of your appointment so that we can make sure your treatment is personalised to suit you.

3. TERMS AND CONDITIONS OF ONLINE PURCHASES

3.1 How can I purchase a product online?

When you order a product using our website you must:

  1. Provide us with your name, contact telephone number, email address and postal address for shipping purposes; and
  2. Complete and submit the online order by selecting an appropriate payment method.

Once you have successfully placed your order, we will send you an email confirmation. Upon the dispatch of your order, we will send you another email with Australia Post Tracking information. If you do not receive email confirmation and shipping details within three (3) business days of placing your order, please contact EBC on 0498 354 241.

EBC reserves the right to refuse any order for products, which are subject to availability. In such case, EBC will notify you as soon as reasonably practicable to discuss an appropriate alternative product or provide a full refund if a product is unavailable.

3.2 What if a I made a mistake in my order?
We encourage customers to carefully select their products using our website as we do not offer refunds or exchanges for change of mind.

In exceptional circumstances and where the customer notifies EBC within two (2) hours of placing an order on info@evodiabeautycare.com.au or 0498 354 241 EBC may, at its discretion, elect to process a refund or amend your order with an alternative product provided the order has not been processed.

3.3 Will I receive a sample with my order?

If you place an order that is under the value of $100 you will receive one (1) sample. Orders with a value of over $100 receive multiple samples.

3.4 If I send EBC a review about a product, will EBC make it public?

If you send us a product review or positive feedback regarding our products or services, we reserve the right to publicly reproduce your review or testimonial on our website or social media platforms. If we intend to identify you or your social media profile in any way, we will notify you in advance and seek your permission.

4. ONLINE PAYMENTS

4.1 Do the prices on the website include GST?

All prices on our website are in Australian dollars and are inclusive of GST. Please note, prices are subject to change without notice. We will use our best efforts to ensure that the prices on our website are current at all times.
4.2 Does EBC apply a surcharge?
The price of each product, including any transaction fees, are listed on the payment portal of our website.

All merchant fees and surcharges charged by the applicable issuing financial institution will be passed on to you and will be payable in addition to the product price.

We are not able to process American Express and Diners Cards payments.

4.3 Does EBC use links to third party websites?

EBC may include links on this website to websites owned by other parties, including but not limited to PayPal and Stripe.

EBC is not in any way responsible for the material contained on these sites, nor is EBC responsible for the availability of these sites at any given time. EBC does not endorse and is not responsible or liable for any content on third party sites, including advertising or products offered on these sites, nor is EBC responsible for any damage, offence or loss caused as the result of visiting these websites.

EBC strongly recommends that before you visit any website you check that your computer is running up-to-date virus checking software. EBC is not responsible for any virus or compromise of your security arising as a result of your accessing a third-party website from this website.

5. SHIPPING POLICY

Your order will be delivered to you by Australia Post.

Orders are usually processed on the same day they are received, during EBC business hours.

5.5 When will I receive my order?

You should expect to receive your order within two (2) to six (6) business days. Please allow extra time as Australia Post is currently experiencing delays due to COVID 19.

Once you have successfully placed your order, we will send you an email confirmation. Upon the dispatch of your order, we will send you another email with Australia Post Tracking information. If you do not receive email confirmation and shipping details within three (3) business days of placing your order, please contact EBC on 0498 354 241.

6 RETURNS AND FAQs

6.1 Can I return items I bought online if they are faulty or damaged in transit?

EBC is happy to exchange or refund any product that is faulty or damaged.

If you receive a faulty or broken product, please contact EBC on info@evodiabeautycare.com.au within fourteen (14) days of receiving the package and we will provide you with instructions regarding how to post the product back to us. EBC will require you provide a photo of the faulty or damaged goods you received prior to approving your refund or exchange.

In all cases, the product must be returned to EBC in its original packaging and in the same condition you received it together with an order number or other proof of purchase.

EBC will cover the shipping costs you incur sending the product back to us if it is faulty or damaged.

A refund or exchange will only be processed once the original purchased product has been received by EBC.

6.2 What if my order is incorrect?

If you have received an item that isn’t what you ordered, EBC is happy to exchange it for the right product.

If you receive the wrong item, please contact EBC on info@evodiabeautycare.com.au within fourteen (14) days of receiving the package and we will provide you with instructions regarding how to post the product back to us.

In all cases, the product must be returned to EBC in its original packaging and in the same condition you received it together with an order number or other proof of purchase.

EBC will cover the shipping costs you incur sending the product back to us.

6.3 What if I change my mind after placing an order?
EBC does not offer refunds for change of mind but may, in its discretion, choose to process an exchange.

If EBC chooses to process an exchange where you have changed your mind, but the product has already been shipped to you, then you must bear the cost of posting the product back to EBC. In all cases, the product must be returned to EBC in its original and sealed packaging and in the same condition you received it together with an order number or other proof of purchase.

Your exchange will only be processed and dispatched once the originally purchased product has been received by EBC. Any applicable price difference will be charged to you or credited to you, as relevant, prior to the exchanged product being sent to you.

6.4 What if my skin reacts negatively to a product?

If, after you have had a skin consultation with EBC, you order a product that we recommended and you have a negative reaction to it we are happy to offer you a refund.

Please notify us as early as possible of your negative reaction to a product on info@evodiabeautycare.com.au or 0498 354 241 and we will provide you with instructions regarding how to post the product back to us.

EBC takes no responsibility and does not offer any refund or exchange where you have purchased a product from our website or Salon without first having a skin consultation with us.

6.5 If I purchased a product online can I return it to the Salon?

You should expect to receive your order within two (2) to six (6) business days. Please allow extra time as Australia Post is currently experiencing delays due to COVID 19.

Once you have successfully placed your order, we will send you an email confirmation. Upon the dispatch of your order, we will send you another email with Australia Post Tracking information. 6.6 Is the returns policy different if I purchased a product with a limited shelf life?

All perishable items, including all items from Bestow Beauty and Botanical Path ranges, must be returned to EBC within seven (7) days of receipt.

6.7 If I am entitled to a refund, how will I receive my money?

All refunds will be issued on the same platform as the original payment was made to EBC. Please note, a refund may take up to seven (7) days to process.

7. PRIVACY POLICY

7.1 Who are we?

This Privacy Policy applies to information that Keiv Investments Pty Ltd (ACN 167 294 939) trading as Evodia Beauty Care (ABN 405 698 556 060) (EBC).

Any reference in this Privacy Policy to we, ours and us in this Privacy Policy refers to EBC. Any reference to you and yours refer to the customer purchasing any products or scheduling any treatment services with EBC.

EBC is committed to protecting your privacy and adheres to the Australian Privacy Principles set out in the Privacy Act 1988 (Cth). EBC reserves the right to change this Privacy Policy from time to time.

This Privacy Policy outlines how we manage the collection, use, disclosure and storage of your personal information and sensitive information. Unless you give us explicit consent otherwise, we will act in accordance with this Privacy Policy about our collection and use of your personal information.

7.2 What kind of personal information does EBC collect?
The types of personal information we may collect and retain depends on the nature of our interaction with you and may include:

  • Contact information such as your name, postal and email address and phone number;
  • Payment information and preferences;
  • Health information, including but not limited to skin concerns, health conditions and any adverse reactions to products or ingredients;
  • Information about your preference for products or the services we offer as well as any feedback you have provided regarding our products and/or services;
  • Information you have provided to us by social networks or mobile applications when you access or engage with our social media platforms; and

EBC uses cookies and similar technologies to track and collect information about which parts of our website are visited by you. This information is used to recognise your computer when you visit our website, to maintain the quality of our services and personalise the information appearing on our website for you. If you prefer that cookies are not stored on your hard drive you can configure your browser to disable cookies, however this may compromise your experience on our website and your ability to process a purchase on our website.

7.4 How does EBC protect the personal information it collects?

EBC is committed to keeping your Personal Information secure and protected from misuse, loss or unauthorised access or disclosure, including but not limited to via SSL Security encryption.

While we take all reasonable measures to protect the Personal Information, we hold about you, we cannot guarantee the effectiveness of our data protection or security measures.

Generally, we only store your Personal Information electronically, however we may also store it in hard copy if necessary.

We only retain your credit card information to process payment of a product or schedule in an appointment for a treatment. EBC does not personally hold your financial information on file, however this information may be stored by a third-party platform that EBC uses to process payments. EBC does not accept any liability in respect of the storage of your financial or other information by any third-party provider.

We will retain your information for as long as permitted and required by law, after which time it will be removed from our systems or destroyed.

7.5 How does EBC use the Personal Information it collects?

EBC may use your Personal Information in the following ways:

  • To confirm your identity and manage your online account;
  • To provide you with accurate and relevant information about our products and services;
  • To send you newsletters or direct marketing campaigns that align with your preferences and previous purchase or treatment history directly or using third party platforms such as “Mailchimp”;
  • To process your payments for products or treatments and protect your financial information against fraudulent transactions using third party platforms which may include PayPal, Stripe or AfterPay powered by Salon Pay;
  • To schedule in your appointments directly or using third party platforms, including but not limited to “Timely”;
  • To follow up or provide confirmation of any purchases or appointments you have made;
  • To provide you with rewards and special offers for being a returning loyal customer;
  • To publish a review or any feedback you provide or send to us on our website or social media platforms;
  • To send you any products which you have purchased from us and schedule in any treatments you have booked with us;
  • To improve the performance of our website and the customer experience;
  • To gather information about our products, sales marketing campaigns and customer demographics;
  • To process your exchanges or returns;
  • To respond to any requests or complaints you make to us; and

7.6 Does the EBC business premises use CCTV?

Yes, there are CCTV cameras installed at the Salon at reception and externally. Accordingly, please be aware that you may be captured on CCTV and your image stored. All CCTV footage is captured purely for your security and for the prevention and detection of crime. There are no CCTV cameras in any consulting rooms. Your privacy is our priority.

7.7 I have questions or an issue with how my Personal Information could be used by ESB, how can I get in contact?

You can request more specific information from EBC about the Personal Information we hold about you, for what purposes it is being collected, held or used.

If you have any queries in relation to this Privacy Policy, or if you would like to request access to your Personal Information or have a complaint about a breach of privacy, then please contact us at info@evodiabeautycare.com.au.

Your enquiry or complaint will be dealt with as soon as possible, but in any case, no later than seven (7) days. If we cannot resolve your complaint within fourteen (14) business days, we will contact you an let you know how long it will take to address your complaint.
